How to know if a business name is available

The question sounds simple, but it hides three different searches that founders routinely collapse into one. A name can pass one and fail another, so it pays to run all three before you commit:

1. The state entity check: can you form your LLC or corporation under this name in your state? You search your Secretary of State's business database. This only tells you whether another company is already registered under a very similar name in that one state.

2. The trademark check: does the name conflict with an existing brand right? You search the federal trademark register for marks that are the same or confusingly similar for related goods and services. This is the one that governs whether you can build a brand on the name without stepping on someone else's rights.

3. The domain and handles check: is the .com (and the social handles you want) unclaimed? A registrar or handle-checker answers this. It's about reach and consistency, not legal rights.

Founders reliably run the entity and domain checks and skip the trademark one. That's backwards, because the trademark side carries the most legal weight. You can register an LLC and buy a domain and still be told to stop using the name, because a prior trademark holder has rights the other two searches never touched. And a plain text search of the register isn't enough: a conflict can sound or mean the same while being spelled differently.

Each search answers only its own narrow question. Clearing the state database doesn't speak to trademarks; owning the domain doesn't either. Even a quiet trademark screen is a preliminary signal, not a final answer: it screens live federal word marks, not common-law, state, foreign, or design rights.
